The essentials
In addition to operating PAYE on an employee’s salary, an employer providing benefits or reimbursing expenses to an employee needs to make an annual return on forms P11D or P9D to HM Revenue & Customs (HMRC). These forms are a minefield and we can prepare them on your behalf to give you the comfort that all the complex tax legislation in this area is complied with. We can also assist by arranging Dispensations for business expenses and advising where PAYE Settlement Agreements are appropriate.

PAYE and NIC rules are complex and it is very easy to unwittingly fail to comply. • PAYE healthcheck – this is a ‘mock’ HMRC PAYE compliance review to identify any problems in advance of the Taxman paying you a visit.

This can be a very ‘grey’ area and the nature of the relationship and the documentation between you and the worker needs to be examined in detail.
• IR35 review – an individual working alone through their personal company may be at risk of the IR35 tax legislation with disastrous tax consequences. It is vital to ensure the relationship is akin to one of self-employment and for the contract to reflect the reality of the situation.
